After 3-month break, Mubarak trial resumes

The trial of ousted Egyptian president Hosni Mubarak resumed Wednesday with the 83-year-old wheeled in on a hospital gurney. Ayman Mohyeldin joins MSNBC live from Cairo, Egypt.

CAIRO -- The trial of former Egyptian president Hosni Mubarak, his two sons, the former minister of interior and six senior security officials resumed in a Cairo court on Wednesday after nearly a?three-month recess.

Egyptian TV showed 83-year-old Mubarak, covered by a green blanket and lying on a hospital gurney as he was brought from a helicopter and taken to an ambulance for the short ride to the courthouse.


The men are all facing murder charges for ordering security forces to kill demonstrators while trying to suppress an 18-day popular uprising against the 30-year rule of Mubarak that began on Jan 25, 2011.

The trial was in recess for close to three months because a separate petition had been filed to replace the presiding judge. That petition was not granted and the same judge will continue to preside over the trial.

On Wednesday, defense attorneys asked the judge to call senior members of the intelligence services and other branches of Egypt's Armed Forces who were serving during the revolution and since then to testify.

The defense is arguing the security forces were acting within the law to contain the uprising but were never given specific orders to "kill" demonstrators.

So far, the most critical testimony of the trial has come from Field Marshall Mohammed Hussien Tantawi, the Commander of the Supreme Council of the Armed Forces, the ruling military council. His testimony has been sealed for security reasons. The defense has also requested the judge hear the testimony of SCAF second-in-command Field Marshall Sami Annan, Chief-of-Staff of the Armed Forces.

The defense believes the two men and other senior officials will testify that they were never given orders by the former president to kill protestors.

The trial has been adjourned until Monday, Jan.?2.

Journalist are allowed to attend the trial under very strict rules as to what they can publish. Egyptian State TV, which was originally allowed to broadcast the trial, has since been barred from broadcasting the trial live.

Revolutionary groups have had a long-standing demand that Mubarak and his aides stand trial for the killing of protestors. The delay in the start of trial and it's lack of transparency has led many to criticize the SCAF that it was?never serious about bringing the former president to justice.

Obesity linked to older adults' risk of falls (Reuters)

NEW YORK (Reuters Health) ? Obese older adults may be more likely than their thinner peers to suffer a potentially disabling fall -- though the most severely obese may be somewhat protected from injury, a new study suggests.

Falls are often seen as a problem for thin, frail older adults, since their bones are especially prone to fracture.

But obesity carries its own risks, according to Christine L. Himes, one of the researchers on the new study.

"People who are obese may have a harder time with balance," said Himes, of Syracuse University in New York.

And when they lose their footing, she told Reuters Health, obese older adults may be less able to react quickly and stop a fall.

In their study, Himes and colleague Sandra L Reynolds found that obese older adults were anywhere from 12 percent to 50 percent more likely to suffer a fall over two years than their normal-weight peers were.

Those odds rose with the level of obesity. The 50-percent higher risk was seen among people with a body mass index (BMI) of 40 or higher -- or about 100 pounds overweight for a man, and 80 pounds overweight for a woman.

The findings, reported in the Journal of the American Geriatrics Society, are based on 10,755 Americans age 65 and up who were surveyed every two years.

Between 1998 and 2006, the group reported a total of 9,621 falls, resulting in more than 3,100 injuries serious enough to need medical attention.

Of people who suffered a fall, 23 percent were obese, compared with just under 20 percent among older adults who did not fall during the study period.

The researchers factored in health conditions that are linked to both obesity and the risk of falling -- like arthritis, pain in the legs, diabetes and stroke. But obesity itself was still linked to a higher fall risk.

When it came to the risk of being injured from a fall, the most severely obese older adults -- a BMI of 40 or higher -- were one-third less likely to be injured than normal-weight people who fell. People with milder obesity, however, showed no such protective effect.

In fact, those moderately obese people were at greater risk of reporting longer-term disabilities after fall, versus normal-weight men and women.

Over the eight-year study, participants reported 4,324 instances of new or worsened disabilities after a fall -- though, Himes noted, it's not certain that the fall caused the problem.

People with milder obesity (a BMI of 30 to 34.9) were 17 percent more likely than normal-weight people to report a disability after a fall. And those with a BMI between 35 and 39.9 were 39 percent more likely to report a disability.

Those patterns make sense, according to Himes. Obese people, in general, may be vulnerable to taking a spill than thinner folks. And when they do fall, Himes said, the most obese people may get some protection from injury by their extra padding and denser bones.

But when obese people who are injured, they may be less likely to get better.

"It's just harder for obese people to recover from injury," Himes said. "They're going to be in poorer physical shape to begin with."

So fall and disability prevention, she said, may be one more reason for people to maintain a healthy weight as they age. "This is just another reason that obesity needs to considered an important public health problem," Himes noted.

Besides losing weight, obese older people may want to be especially mindful of cutting their fall risk in other ways. In general, experts recommend regular moderate exercise like walking and tai chi to improve balance and coordination; getting rid of fall hazards in your home, like loose rugs or any other obstacle you might trip over; and using assistive devices such as grab bars for the tub or shower.

It's estimated that more than one-third of Americans age 65 and up suffer a fall each year. And a similar proportion of older adults are obese -- a trend, Himes noted, that is likely to get worse.

Study uncovers a molecular 'maturation clock' that modulates branching architecture in tomato plants

The secret to pushing tomato plants to produce more fruit might not lie in an extra dose of Miracle-Gro. Instead, new research from Cold Spring Harbor Laboratory (CSHL) suggests that an increase in fruit yield might be achieved by manipulating a molecular timer or so-called "maturation clock" that determines the number of branches that make flowers, called inflorescences.

"We have found that a delay in this clock causes more branching to occur in the inflorescences, which in turn results in more flowers and ultimately, more fruits," says CSHL Assistant Professor Zach Lippman, who led the research team. The new study, which involved a high-resolution, genome-level comparison of the stem cell populations from three tomato varieties that each have different branching architectures, will appear online in the Proceedings of the National Academy of Sciences during the week of December 26.

When a plant is ready to flower, populations of stem cells, called shoot apical meristems, which are found in the growing tips, stop producing leaves and begin producing flowers by transforming into "inflorescence meristems." Depending on the tomato variety, inflorescences meristems can make just one branch with a few flowers arranged in the familiar, photogenic zigzag pattern (shown), or multiple branches with dozens of flowers, as seen in closely-related wild relatives of tomatoes, which are native to South America.

Although most domesticated varieties, which have been bred to produce edible, delicious fruit, produce a single inflorescence branch with just a few flowers, some varieties make dozens of branches bearing hundreds of flowers. "Although one might think that all this branching is good, too much branching is not a desirable trait, because the plant spends so much energy on making flowers on those branches that it ends up not having the resources to set those flowers into fruits," explains Lippman. "So there needs to be a balance, which the wild relatives of tomatoes seem to have achieved."

Previous studies hypothesized that extreme branching might be the result of a pause or a delay in the maturation of inflorescence meristems, causing them to sprout extra branches instead of ending their growth by making flowers. "Our previous work as well as those of others hinted at the existence of a timer or clock," Lippman notes. "We wanted to define this clock at the highest resolution, in terms of the genes that modulate the rate of meristem maturation, with the idea that finding the genes that define the clock would enable us to tweak it to get the desired level of branching."

Using a systems biology approach and next-generation sequencing technology to "capture" the transcriptome? the activity of all the genes in a genome ?of stem cells at five different stages of maturation, the team identified nearly 4000 genes that represent the clock. With help from CSHL associate professor and computational biologist Michael Schatz, the team, which included post-doctoral researchers Soon-ju Park and Ke Jiang, compared the clocks of a mutant variety that undergoes extreme branching and a wild relative from Peru that undergoes modest branching.

This analysis revealed that subtle differences in the activity of the clock's genes could alter branching architecture. "Our data showed that wild relatives of tomato have evolved to have a slight delay in maturation, which leads to just a few more branches and a doubling of the number of flowers and fruits compared to what is typically found on cultivated tomatoes grown for ketchup or in the home garden," explains Lippman, who is enthusiastic about the implications of this work and the next steps that his team will take. "We now have a master list of candidate genes that we can go after to manipulate the clock in order to make domesticated tomatoes produce a branching architecture that's similar to the wild variety," he says.

U.S. Settles With Exelon Over Constellation Energy Deal

Dec. 21 (Bloomberg) -- The U.S. Justice Department agreed to let Exelon Corp. carry out its $7.9 billion acquisition of Constellation Energy Group Inc. on condition that Exelon sell three electricity-generating plants in Maryland.

The department announced the agreement today shortly after it filed a lawsuit in U.S. District Court in Washington alleging the takeover would eliminate competition and lead to an increase in wholesale electricity prices for consumers in Mid-Atlantic states. The agreement must be approved by a federal judge.

?Competition in wholesale electricity markets is vital to the economic well-being of consumers and businesses,? Sharis Pozen, acting assistant attorney general for the department?s antitrust division, said in an e-mailed statement. ?These divestitures will preserve that critical competition for the benefit of electricity customers throughout the mid-Atlantic.?

Exelon expects to complete the transaction early next year, Christopher Crane, who?ll become chief executive officer of the combined company, said today in a statement announcing the settlement.

The deal would create the largest U.S. utility owner and power generator. Sale of the three Baltimore-area plants was included in the initial takeover announcement by Chicago-based Exelon on April 28 to reduce the combined company?s market share in PJM Interconnection LLC, the largest U.S. power market.

Exelon on Oct. 11 announced additional terms for sale of the plants had satisfied the market monitor of PJM.

Maryland Accepts

Maryland?s governor and energy department also accepted those terms as part of a Dec. 14 settlement. That state?s utility regulator is scheduled to decide on the deal Feb. 17.

Exelon already has approval for the transaction from regulators in Texas and New York. It had asked the Federal Energy Regulatory Commission for a decision by Jan. 5.

Exelon announced the takeover of Baltimore-based Constellation in April. It will gain stakes in five nuclear reactors and become the largest U.S. electricity marketer. Exelon is the largest owner and operator of U.S. nuclear plants, and owns electric utilities Commonwealth Edison in Chicago and Peco Energy in Pennsylvania.

Constellation owns utility Baltimore Gas & Electric. Most of its revenue comes from retail sale of electricity in states that allow competition, a business assembled and expanded by Chief Executive Officer Mayo Shattuck after the collapse of energy trader Enron Corp. in 2001.

If completed, the deal will be Exelon?s largest transaction. Exelon has tried unsuccessfully three times to buy other power companies since 2003, and Constellation has been the target of two failed bids. A $14.8 billion sale of Constellation to NextEra Energy Inc., the largest U.S. wind-power generator and owner of Florida?s largest utility, collapsed in 2005, with NextEra citing interference by officials in Maryland.

The case is U.S. v. Exelon Corp., 11-cv-02276, U.S. District Court, District of Columbia (Washington).

How the iPad 2 Became My Favorite Computer

Can the iPad replace a PC?

Ever since Apple announced its tablet nearly two years ago, the Internet has been awash in discussion of this question. Most of it has had a pretty theoretical feel and has gravitated toward conventional wisdom. A piece by Gotta Be Mobile?s Will Shanklin comes to the typical conclusions:

Whether you can replace your laptop with an iPad is going to depend on what your needs are. In early 2010, casual computer users could arguably replace a laptop with an iPad. Now it?s a no-brainer. When it comes to content consumption, a tablet is lighter, more portable, more comfortable, and more personal.

If part of your life involves creating professional-level content, tablets still have a long way to go before becoming your primary device. They don?t qualify now, and they won?t next year. Customers aren?t used to spending more than $10 for most tablet apps, so those consumer expectations could slow the march in this direction too.

The answer, therefore, hasn?t changed too much in a year. Tablets are moving in a ?primary computing? direction, but they aren?t exactly sprinting. Maybe we?ll check back next year to see if the ?tablets are for content consumption, notebooks are for content creation? cliche has changed. Right now it?s as true as ever.

I respectfully disagree with Shanklin. I think it?s possible to use an iPad as one?s primary device for professional-level content creation. Actually, scratch that. I?m positive?it?s possible ? because I?ve been doing it for the past three months, and I?ve been having a really good time.

This hasn?t been one of those experiments-for-the-sake-of-experimentation in which someone temporarily forsakes a PC for another device in order to write about the experience (like, say, this). No, I?ve been using the iPad for my daily activities ? running Technologizer, writing for TIME, CNET and AllBusiness.com and more ? because I find it to be the preferable tool in multiple respects. I?ve been using it about 80% of the time, and using my MacBook Air about 20% of the time. I have no desire to go back.

If this startles you, I understand. It seems to startle most folks who notice I?m doing it. I?m startled myself. Or at least I was at first ? at this point, I?ve been doing it long enough that I forget there?s anything unusual about it until someone reminds me.

It all started in August. I read Walt Mossberg?s review of four portable Bluetooth keyboards for the iPad 2 at All Things D and was intrigued ? especially by the ZaggFolio, which cleverly builds a truly notebook-like keyboard into an attractive case. So I bought one. The ZaggFolio changed the way I use my iPad, and that changed my life.

Without the ZaggFolio, I used the iPad mostly for reading and light productivity. I?d happily type brief e-mails on it, but never anything as long as a meaty blog post or article. But Zagg?s no-compromise keyboard made typing every bit as comfy as it is on a notebook. All of a sudden I could write hundreds of words on the iPad. Or thousands of them.

(Side note: the ZaggFolio I bought was part of an early production run that was defective ? its clasp didn?t shut securely. And after a few weeks, one of its keys fell off. I ended up replacing it with the Logitech Keyboard Case by Zagg for iPad 2, which puts a similar keyboard in a low-profile tray that doubles as a protector for the iPad 2?s screen. I prefer both of these models to rivals like the Adonit Writer, which don?t match the full-size, full-travel goodness of Zagg?s designs.)

Of course, having a nice keyboard for an iPad doesn?t instantly turn it into a pleasing laptop replacement. You?re typing into a radically different set of apps than are available on a notebook. Once I got the ZaggFolio, I had to figure out how to blog, edit photos and perform other tasks I do every day.

Boehner Makes Payroll Deal ? Will GOP Rebel?

Congressional leaders announced Thursday that they've struck a deal to ensure the payroll tax rate does not rise at the beginning of next year, potentially ending a stalemate that had put House Speaker John Boehner in a politically uncomfortable position.?

Following a day of political grandstanding by members of both parties, as well as private talks in pursuit of an agreement, Boehner said at a news conference late Thursday that the House plans to vote on a new version of the Senate-passed bill -- which would extend the payroll tax cut for another two months -- despite earlier opposing a short-term extension.

In exchange, the Senate will appoint negotiators who will meet with House lawmakers to next hammer out an extension of the tax cut for the rest of 2012.?

The deal still has to clear both chambers, and rank-and-file Republicans already are expressing concern about the terms Boehner outlined. But the agreement was modeled after a solution Senate GOP Leader Mitch McConnell proposed earlier Thursday.?

McConnell's statement, as well as a very public campaign by the White House to lambaste House Republicans for holding up a deal, had put pressure on Boehner to find a way out of the impasse, and fast. Without a deal, the payroll tax rate is set to rise from 4.2 percent to 6.2 percent on Jan. 1, which would mean about $40 less a paycheck for a family making $50,000.?

"On Jan. 1, no American worker will see an increase in their taxes," Boehner assured Thursday. "I think this agreement will help our economy."?

The deal is a turnaround for Boehner, who until Thursday was abiding by rank-and-file wishes to reject the Senate's two-month package and instead demand the Senate work out a yearlong package before Jan. 1.?

Boehner conceded Thursday that this position "may not have been politically the smartest thing in the world."?

The speaker still has to keep control of a restive caucus in order to deliver on Thursday's agreement. Boehner said the goal is for both chambers to approve the final package by Christmas. And he wants lawmakers to approve it by "unanimous consent" -- meaning leadership would have to pre-clear the deal with all members to ensure there are no objections, so most lawmakers wouldn't have to return to Washington for a regular roll-call vote.?

However, early reaction from rank-and-file Republicans reflected dissension in the ranks once again. One Republican member told Fox News, "I'm thinking of objecting myself. We were hung out by leadership."

Another member who was on a brief Republican conference call Thursday predicted the deal Boehner struck could cause problems for the speaker. "He may have a hard time keeping his speakership after this," the lawmaker said.?

Still another lawmaker said Republican members "never would have gone along" with the deal.

Boehner said Thursday that if he has to, he "absolutely" will call members back to Washington for a vote. But he made clear that he supports his caucus' intentions, even if the politics of the debate caused problems. He praised House GOP lawmakers for waging a "good fight," complaining that short-term "gimmicks" like the Senate-passed bill feed "uncertainty" in the economy.?

"Doing the right thing for the right reasons is always the right thing to do," Boehner said.?

Democrats will surely count this as a victory, presuming the agreement plays out according to plan.?

Senate Democratic Leader Harry Reid said in a written statement that he was "grateful that the voices of reason have prevailed" and that Boehner agreed to take up the Senate bill.?

President Obama also put out a statement welcoming the agreement. "This is good news, just in time for the holidays," he said. "This is real money that will make a real difference in people's lives."

Until now, House Republicans have refused to approved the stop-gap measure passed by the Senate that would have extended the payroll tax cut for another two months. Republicans argue a short-term extension is bad policy, but Democrats, including Obama, have said it is the only way to ensure taxes don't increase on Jan. 1, while the two sides negotiate a longer deal.

Sources tell Fox News that the plan is for the House to originate a new payroll tax bill as early as Friday.?

The tradeoff from Democrats in the Senate is that Reid would appoint conferees so they could have a genuine conference committee between the House and Senate to negotiate differences for a yearlong package. The Republicans' provision calling for a decision from Obama on the controversial Keystone pipeline project would remain in the bill.

In addition, the pact would have what was described to Fox News as some "wonky provisions" to help accountants and others who run payrolls get more certainty on the tax code.

The Senate would have to approve the House bill as well. Then, the conference committee would meet in early January to work on deal to extend the payroll tax cut for a full year.

If all goes according to plan, neither House nor Senate would not have to bring everyone back, since this could be addressed on the floors of the House and Senate with skeleton staff.?

The announcement of this year's recipient was delayed by almost two weeks.? The award is usually presented on International Human Rights Day on Dec. 10.? Ni's selection as the 2011 award winner was made by an independent judging committee in late November, but because she was at the time facing trial, her daughter and lawyer requested that the announcement of her selection be delayed to protect her.

Asian stocks lower after US, Europe fall (AP)

BEIJING ? Asian stock markets fell Thursday, ending a two-day rally after investors were rattled by the European Central Bank's huge loan to bolster the continent's banks.

Tokyo's main index was off 0.6 percent at 8,407.1 and China's benchmark declined 0.4 percent to 2,181.5. Taipei, Hong Kong and Sydney also were down.

The declines came after Asian stocks plunged early this week on anxiety over the death of North Korean leader Kim Jong Il, then rallied on positive U.S. construction data and a strong Spanish government debt auction.

"We're seeing the markets fall on their own weight here in Asia, with no one looking to step in and buy," said Chris Weston, an institutional dealer for Australia's IG Markets.

On Wednesday, investors were spooked by the huge size of the ECB's euro489 billion ($639 billion) loan to 523 banks ? its biggest credit infusion to date as authorities try to steady a financial system under pressure from Europe's debt crisis.

The loan will help to ensure banks have enough money to lend next year but cannot address the underlying problem of government debts.

"The ECB tender was obviously a good situation. It alleviates some of the symptoms. But it's not going to change the situation long-term," said Weston.

European markets fell Wednesday and on Wall Street, the Dow Jones Industrial Average was off 0.5 percent. The broader S&P 500 index fell 0.6 percent, led by an 11 percent decline for Oracle Corp., which said it was struggling to close deals, reinforcing worries business and the government may cut technology spending.

European officials says banks need to raise euro115 billion ($150 billion) in new capital but investors are leery of putting more money into them. It would be politically unpopular for governments to do it and their finances are stressed as well.

Elsewhere in Asia, Hong Kong's Hang Seng was off 0.5 percent at 18,318.3 points while Seoul's Kospi was down 0.1 percent at 1,845.85.

Taipei's Taiex lost 0.1 percent to 6,857.44. Singapore declined 0.4 percent to 2,663.65 while Sydney's S&P/ASX 200 shed 1.2 percent to 4,090.8.

Benchmark crude for February delivery was up 16 cents at $98.83 in electronic trading on the New York Mercantile Exchange.

The euro was little changed at $1.3044 while the dollar was off slightly at 78.04 yen.

Files on Manning's computer linked to WikiLeaks site (Reuters)

FORT MEADE, MD (Reuters) ? Classified files downloaded to the computer of Army intelligence analyst Bradley Manning matched those that later showed up on WikiLeaks, an investigator testified on Sunday, the first time the government has linked Manning to the whistleblowing website.

Special Agent David Shaver, a computer crimes investigator with the military, said an analysis of Manning's two classified computers revealed hundreds of sensitive files and file fragments that were accessed or downloaded through the military's secret computer network.

Manning's defense attorney, David Coombs, has largely ignored the question of whether his client is to blame for the leaks but has focused instead on why Manning continued to have access to classified material despite warning signs of emotional instability.

Coombs noted on Saturday that Manning "got furious and upset" during an outburst, flipped a table and sent a computer crashing to the ground. Manning had to be restrained over fears he was headed for a weapon.

Shaver's examination of Manning's computer also found thousands of State Department cables and two versions of an Apache gunsight video that showed an attack that killed several Iraqis, including two Reuters journalists.

One version of the video matched the film aired by WikiLeaks in 2010 and the other appeared to be the source, he said.

Shaver, who faces cross-examination from the defense on Monday, said he compared the files on Manning's computer to documents he downloaded from WikiLeaks and found to be the same.

Manning is suspected of downloading thousands of government files from the military's classified computer network when he was stationed in Iraq, information that later showed up on the WikiLeaks website in the largest unauthorized release of classified documents in U.S. history.

Shaver's testimony came on the third day of a hearing to determine whether there is sufficient evidence to try the 24-year-old Manning at a general court martial on charges of aiding the enemy and 22 other counts. If convicted of the most serious charges, he could be sentenced to life imprisonment.

Shaver said Manning's computer profile had been used to carry out more than 100 searches of the military's Secret Internet Protocol Router Network, known as SIPRNet, for documents naming WikiLeaks or its founder Julian Assange.

Shaver also recreated a path used on Manning's computer to download assessment documents written about detainees in the U.S. war against al Qaeda who were being held at the military prison at Guantanamo Bay, Cuba.

EMOTIONALLY UNSTABLE?

Among files that had been deleted from Manning's user profile were several complete Guantanamo detainee assessments, Shaver testified.

The prosecution has portrayed Manning as a well-trained analyst who was particularly knowledgeable about computers and who understood his responsibilities but violated them.

But the defense has sought to portray him emotionally unstable and unsuitable for his job as an intelligence analyst.

The defense showed Manning sent an email to Sergeant Paul Adkins, a superior in charge of security at his intelligence installation in Iraq, in April 2010 in which he said he suffered from a gender identity disorder that was affecting his life, work and ability to think, according to testimony Saturday.

The email included a photo of Manning as a woman. A superior officer said Adkins did not tell him about the email until after Manning's arrest. Manning, it was disclosed during the proceedings, created a female alter-ego online, Breanna Manning.

Captain Casey Fulton, an Army intelligence officer who worked in the same secure facility as Manning, testified that she saw Manning curled up on the floor with his arms around his knees as Adkins spoke to him.

Adkins invoked his right against self-incrimination on Sunday as he began answering questions in the case against Manning. Coombs argued Adkins should not be excused because he was not under investigation in the case, but the prosecution declined to grant him immunity to testify and he was excused.

The defense has portrayed Adkins as someone who should have recognized the private's troubled emotional state and acted to revoke the security clearance that gave him access to classified U.S. documents.

As it cross-examined prosecution witnesses on Sunday, the defense team continued to suggest Manning should not have had access to classified documents given his emotional state.

Fulton, who used Manning in her work preparing for the Iraqi election, rejected suggestions that supervision of lower-level analysts like Manning was lax.

"It's impossible to supervise 100 percent of the time," she said. "There's a limited amount of supervisors and you can't supervise everyone at every second of the day. (You) trust that they'll safeguard the material the way they've been taught."

Keystone XL pipeline: a jobs coup for Republicans in tax deal? (The Christian Science Monitor)

A congressional deal to preserve a payroll tax cut for working Americans, approved by the US Senate Saturday, also contains a provision designed to force President Obama's hand on the controversial Keystone XL oil pipeline.

Republicans who pushed for the provision say the pipeline would be a slam-dunk win for a US economy that desperately needs jobs.

It now appears that when a bill lands on Mr. Obama's desk, with tax cuts that the president endorses as his own way to boost the economy, it will also include a call for him to decide within 60 days whether the Keystone pipeline for Canadian oil should be built.

Senate Republicans insisted the pipeline provision be included in the tax bill. The measure still needs a vote of approval in the Republican-controlled House of Representatives.

The pipeline, which would create jobs but angers environmentalists, has become a political flashpoint in recent months.

In November, Obama announced his intent to delay a decision until after the 2012 election, thus averting a difficult political dilemma. 

Approving the plans of the Canadian firm TransCanada would have run afoul of environmentalists worried about threats to the massive Ogallala aquifer, which the pipeline would run past. Even Republicans in Nebraska have voiced opposition to the planned path of the project for that reason. 

But denying support would have opened Obama to new jabs from critics who say he's not doing enough about the nation's most urgent priority, job creation. Even his delay, however, prompted that reaction.

Where Obama framed his choice as taking time "to ensure that all questions are properly addressed and all the potential impacts are properly understood,? Republican presidential candidate Newt Gingrich called any reluctance about the project "utterly irrational."

Rep. Michele Bachmann of Minnesota, another candidate at the Republican debate in Iowa on Thursday, accused the president of making a decision for reasons of politics rather than national interest. 

"This pipeline is one that would have brought at least 20,000 jobs, at least $6.5 billion worth of economic activity," she said. "His entire calculus was based upon his reelection effort. Because quite frankly, the radical environmentalists said to President Obama, you pass Keystone, we're not going to do your volunteer door-to-door work."

Former House Speaker Gingrich said a delay could mean that jobs and economic activity permanently flow elsewhere.

"The Canadian prime minister has already said to the American president, if you don't want to build this pipeline to bring ? create 20,000 American jobs and bring oil through the United States to the largest refinery complex in the world, Houston, I want to put it straight west in Canada to Vancouver and ship the oil direct to China," Gingrich said at the debate. "You'll lose the jobs, you'll lose the throughput, you'll lose 30 or 40 years of work in Houston."

The Keystone XL project would be a roughly 1,900-mile extension of an existing Canadian-operated pipeline that ends in Illinois. It could bring Alberta oil to refineries in the Southern US.

Positions taken in the Senate this week echoed the long-running arguments on both sides.

Sen. Patrick Leahy (D) of Vermont said Republicans are using "scare tactics" about jobs.

"Unable to sell the pipeline as necessary to meet the country?s energy needs, which it is not, or to refute charges that tar sands strip mining and the refining and burning of high carbon oil cause egregious harm to the environment and health, which it does," TransCanada is making dire warnings about the jobs at stake, Mr. Leahy said in a Senate floor statement. Republicans "have echoed these scare tactics."

Sen. Dan Coats (R) of Indiana, by contrast, said "If job creation is the president?s top priority, then [Obama] should allow construction of the Keystone pipeline immediately." He said thousands of jobs would be matched by reduced reliance on Middle East oil.

A State Department analysis of the Keystone plan pegged the job gains as far fewer than 20,000. The report estimated that "The construction work force would consist of approximately 5,000 to 6,000 workers, including Keystone employees, contractor employees, and construction and environmental inspection staff."

One reason for the different job estimates is the temporary nature of the jobs. The 20,000 figure, promoted by backers of the project, is based on "person-year" estimates. In that framework, employing 6,000 people for three years would equal 18,000 jobs, for example.

Critics of the project also argue that much of the oil processed in refineries near the Gulf of Mexico would be destined for export.

Beyond the specifics of the pipeline project, Keystone has become a symbol of a larger battle over energy policy under Obama. The president argues that he is taking a balanced approach, open to new fossil-fuel development with appropriate safeguarding of the environment. 

The Republican candidates for president have blasted him for regulatory overreach that is preventing a potential boom in jobs and domestic energy production.

Interest groups, meanwhile, are lobbying hard to influence Obama's ultimate decision on Keystone.

"The Republican stampede to build the Keystone XL tar sands pipeline is going to backfire," predicted Susan Casey-Lefkowitz of the Natural Resources Defense Council in a statement Saturday. "In forcing President Obama to reach a hasty decision ? which he has said he would not do ? the president will have no choice but to reject the pipeline as not in the national interest.?

WELLINGTON, New Zealand ? The 32 crew members aboard a leaking Russian fishing ship near Antarctica have made progress stabilizing the vessel, and a plane is scheduled to drop them supplies.

The vessel Sparta on Friday hit underwater ice, which tore a one-foot (30 centimeter) hole in the hull and caused it to list at 13 degrees. Maritime New Zealand, which is coordinating rescue attempts, said in a statement Saturday the crew had pumped water from the vessel overnight and moved cargo about, making the boat safer and more stable.

Crew members who had donned emergency suits and boarded life rafts were now back aboard the Sparta, the agency said.

A New Zealand Defence Force C-130 plane is scheduled to drop fuel and equipment to the vessel later in the day.

Rescue ships, hampered by heavy sea ice, are still several days away from the vessel.

HBT: Bonds to be sentenced for obstruction of justice

Barry Bonds finds out the penalty for minor hemming and hawing today, as he will be sentenced in U.S. Federal court for his April conviction.

Most likely: probation in the form of house arrest. I?m assuming his house is pretty nice, though. ?But that?s what other athletes in the BALCO case have gotten for single-count convictions. The feds want him to do hard time, but it just ain?t gonna happen.

But no matter what happens, this should serve as a lesson to all of you: don?t ramble for a minute before answering a question. Ever.

What we have here is an excellent video walkthrough of a couple of Verizon Galaxy Nexus accessories that should be available in the morning -- the navigation vehicle mount and the spare battery charging kit -- from forums member Aatrek.

Note it's a "Navigation vehicle mount" and not a "Car dock" or anything. It's a hunk of plastic that the phone sits in, that's all. No contact charging, no Bluetooth audio. In other words, it does not bring, as the kids say, the sex. The spare battery charger, on the other hand, chargers a spare battery. No muss, no fuss.

Jewish settlers set fire to mosque, defy Netanyahu (Reuters)

JERUSALEM (Reuters) ? People thought to be Jewish settlers set fire to a mosque, damaging its interior, in the West Bank on Thursday after Israeli forces tore down structures in a settler-outpost built without government approval.

The vandalism appeared to be the latest act of defiance by militant settlers whom Israeli Prime Minister Benjamin Netanyahu has vowed to rein in after similar attacks on mosques and vandalism at an Israeli military base.

In the village of Burqa, near Ramallah, the interior of the local mosque was doused with petrol and set alight. Its carpet, walls, chairs and electrical wiring were damaged.

"Thankfully, the torching occurred shortly before dawn prayers, and the villagers who arrived at the mosque put out the fire," said Mahmoud al-Habash, the Palestinian minister of religious affairs.

The mosque was defaced with Hebrew graffiti that said "war" and "Mitzpe Yitzhar," the name of the outpost where the demolitions had taken place hours earlier.

On Wednesday, radical Jews burnt the exterior of an unused Jerusalem mosque and scrawled "Death to the Arabs" on its walls.

A day earlier, young Jewish settlers rampaged through a military base in the occupied West Bank. The attack against the armed forces, an institution revered by many Israelis, sent shock waves through Israel.

"HATE CRIMES"

In a statement on Thursday, Israeli President Shimon Peres condemned the settler attacks and said they were "pouring oil on the flames" of hostility towards Israel in a tense Middle East already in political turmoil.

The Palestinian Authority described the mosque burnings as "hate crimes" and in a statement called on the international community to hold the Israeli government responsible for settler violence.

Attempts to demolish unauthorized outposts have been resisted by radicals who scuffle with troops or carry out night-time sabotage to inflict what they call the "price tag" for "selling out" the settlements.

Most countries regard as illegal all of the settlements that Israel has built in territory it captured in a 1967 war and which Palestinians seek for a future state. Israel cites historical and biblical links to the land it refers to as Judea and Samaria.

Although Israel continues to expand larger official settlements, it has been evacuating smaller, unauthorized outposts, in line with court orders to move against them.

After consulting with security chiefs, Netanyahu said on Wednesday he would take the rare step of ordering so-called administrative arrests -- detention without trial -- of Israelis suspected of vigilante attacks.

The measure, widely seen as having been sparked mainly by the attack on the army base, has been more commonly used against Palestinians suspected of involvement with militant groups.

Israel has long been accused of failing to arrest or investigate settlers for acts of violence against Palestinians.

Police said they had entered Burqa to investigate the arson attack on the mosque.

Sudan border fighting displaces over 400,000 people: U.N. (Reuters)

KHARTOUM (Reuters) ? About 417,000 people have been displaced in Sudan's border states of South Kordofan and Blue Nile as a result of ongoing fighting between the army and insurgents, the United Nations said on Tuesday.

Fighting broke out between Sudan's army and SPLM-North rebels in June in South Kordofan which borders newly-independent South Sudan. Violence spread to the neighboring northern border state of Blue Nile in September.

About 82,000 people have fled both northern states to South Sudan or Ethiopia to escape fighting, U.N. officials told reporters in the capital Khartoum. Some 35,000 people from South Kordofan have fled to Khartoum to stay mostly with relatives.

The humanitarian situation was deteriorating, especially in areas controlled by the SPLM-North, as U.N. and aid agencies were still being denied access, said Peter de Clerq, U.N. Humanitarian Coordinator in Sudan.

"We have made many interventions with the government in terms of going back to South Kordofan and Blue Nile, so far we have not yet been successful in accomplishing that," he said.

"We are in no position to verify the actual needs on the ground as we are simply not there...we have little information," he said.

Sudan said it would continue to deny access, citing security reasons.

"The government cannot allow NGOs to these areas at least this time because the government cannot guarantee their safety. Still there is fighting...there is kidnapping," said Mohammed Fadlallah, acting commissioner of the official Humanitarian Aid Commission (HAC).

He said Sudanese aid agencies were providing aid in government-controlled areas to where some displaced persons had been returning.

North and South Sudan regular trade accusations of supporting insurgencies on each other's territory. Their armed forces clashed at Jau in a region claimed by both sides last week in a rare direct confrontation.

The two countries are already holding tense talks over issues such as oil and debt that have been unresolved since South Sudan seceded in July.
